These Terms & Conditions are effective as of 1/07/2023.

By continuing to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which govern iRecycle’s relationship with you in relation to this website. The term ‘iRecycle’ or ‘us’ or ‘we’ refers to the owner of the website. The term ‘you’ refers to the user or viewer of our website. Basically, you agree to these terms when you use the site and the services provided on from this website

1. INTRODUCTION

These terms of use (together with the other documents we refer to) set out the terms on which you may make use of our website https://www.irecycle.in(our site). Use of our site includes accessing, browsing, or registering to use our site. Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site. By using our site, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use our site.

Use of the Website is offered to you conditioned on acceptance without modification of all the terms, conditions and notices contained in these Terms, as may be posted on the Website from time to time. irecycle.in at its sole discretion reserves the right not to accept a User from registering on the Website without assigning any reason thereof.

2. INFORMATION ABOUT US

https://www.irecycle.in is an internet based Repair, Recycle and e-commerce portal operated by DIVYAMILAN REAPAIR AND SERVICES LLP ("We") incorporated under the laws of India. We are registered in Mumbai, India and have our registered office at Mumbai.

3. CHANGES TO OUR WEBSITE

We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it.
We do not guarantee that our site, or any content on it, will be free from errors or omissions.

3. USING OUR WEBSITE

General access to our site is made available free of charge. We charge to access premium features via monthly subscription. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our site and you may only use our site for lawful purposes. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian.

https://www.irecycle.in will take "Full Responsibility" of your Order, if the Order has been shipped to any of the major cities to ship your order.

The prices and availability of products are subject to change without prior notice at the sole discretion of DIVYAMILAN REAPAIR AND SERVICES LLP ("We")

https://www.irecycle.in reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment been received. The payment shall be refunded and the user shall be informed of the same.

If a non-delivery or late delivery occurs due to a mistake by the User (i.e. wrong or incomplete name or address or recipient not available) any extra cost spent by TDIVYAMILAN REAPAIR AND SERVICES LLP("We") for re-delivery shall be claimed from the User placing the order.

The User agrees to give accurate, authentic and true information. https://www.irecycle.in reserves the right to confirm and validate the information and other details provided by the User at any point of time. If any such User details are found not to be true wholly or partly, https://www.irecycle.in has the right in its sole discretion to reject the registration and debar the User from using the services of https://www.irecycle.in without prior intimation whatsoever.

DIVYAMILAN REAPAIR AND SERVICES LLP ("We") will not be liable for any type or kind of credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user. The User must exclusively use his/her own card on the site.

DIVYAMILAN REAPAIR AND SERVICES LLP("We") shall not entertain any complaints after 15 days, once the order is delivered

4. ACCOUNT AND PASSWORD

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. 5. SERVICES

Serving as a bridge between repair parts & repair stores, we provide information and insight to repair stores(requires iRecycle Membership) about the repair parts(Replacement/NEW/OLD) available near you.

irecycle.in provides a number of Internet-based services through the Web Site (all such services, collectively knowns as the "Service"). One such service enables users to purchase refurbished phones, laptops, and other electronics of various types of brands. (collectively known as "Products"). Upon placing an order, irecycle.in shall ship the product to you and be entitled to its payment for the Services.Another Services iRecycle provides are Repair Service and iRecycle Memberships

Repair Service helps user's device repaired via online booking
iRecycle Membership requires subscription plan and user get access to the repair parts available nearby and iRecycle community page where then can sell their own parts.

6. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organization to content posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged. If you are a consumer user, please note that we only provide our site for domestic and private use. Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
You warrant that any contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty. Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us a limited license to use, store and copy that content and to distribute and make it available to third parties.
We also have the right to disclose your identity to any third party who is claiming that any posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy. We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site.
We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out above. We may also take any other action we deem appropriate. The views expressed by other users on our site do not represent our views or values.

10. VIRUSES

We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform in order to access our site. You should use your own virus protection software. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

You may link to our site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice.

This agreement shall be construed in accordance with the applicable laws of India

Repair terms and condition

All repairs (unless otherwise stated)

The terms set out in these Conditions of Repair (“Agreement”) shall apply to the service (“Service”) we provide to repair your smartphone, tablet, computer and/or any accessories (“Device”) on the service check-in form.Reference to “us”, “we” and “our” refer to Mobile Phone Repair Centre and references to “you” and “your” are references to you (“Customer), the person addressed on this form.
This Agreement shall commence from the date you book a repair and shall continue until we have repaired or otherwise returned your Device, whichever is sooner, and received any payment due from you.
We shall make reasonable efforts to repair your Device subject to the availability of any parts required and/or the terms of any relevant guarantee or warranty. We shall perform the Service using our utmost care and skill.
We shall use Genuine, OEM or High Quality compatible parts for the repairs of all Devices.
We shall require the passcode of your Device in order to test the Device before and after the Service. Should you prefer to keep this information private, we can still proceed with an appointment, but will not be able to perform a full functional check on the Device until you provide the passcode or return to the store, which can delay the provision of the Service, if any adjustments need to be made.
Any time estimate for completion of the service, which may be given to you, is an estimate only and does not form any obligation under the terms of this Agreement. We will aim to return your Device as soon as reasonably possible, however, any Board Level (Level 3) repairs (i.e. repairs to the logic board of the Device) may take additional working days to be completed.
We shall notify you when the Device has been repaired. If necessary, we shall send a reminder and the device will be recycled if not collected by day 90 to cover our costs.
If we are unable to complete the Service for any reason, or the Service will incur further costs payable by you beyond that initially estimated by us, we will notify you immediately via telephone and/or email. If no fault is found on your Device or you do not accept our revised estimate, we will return your Device to you unrepaired and we reserve the right to charge you an inspection fee in accordance with our standard charges.
The cost of repair will be calculated where possible in accordance with our standard charges as published from time to time.
We shall be entitled to keep your Device until all charges payable have been paid. We may also charge an additional fee for storage of your Device.
Use of our service may void your manufacturer’s warranty. If you would like to avoid this, then please take your Device directly to the manufacturer. Please note, your manufacturer’s warranty will not cover any accidental damage.
iRecycle may install warranty seals following the repair. Any tampering of the seals will void our warranty.

Repair Warranty

The Warranty is linked to a specific device as identified by its unique IMEI or serial number and to a specific Customer as identified by the records on our system. It will cover the Customer for any re-occurrence of the original fault and for the part replaced / repaired only, however if additional faults arise, they will not be covered under the terms of this Warranty.Furthermore, the Warranty will not cover accidental damage and not transferable across devices or if the device is sold or handed over to another individual.
We do not accept responsibility for any progression in damage where your Device has been repaired elsewhere prior to your repair at iRecycle or any issues found in your Device (i.e. ‘Touch Disease’, ripped flex) which were not evident upon initial inspection.Should any issues become evident, once the Device is opened [Examples of this may include missing screens and torn flex cables.], iRecycle Technician will explain upon diagnosing the device and if device is collected by us we will contact you via telephone/email.
We do not accept responsibility for any progression in damage for Devices that have been damaged by liquid. Opening the Device could set off further damage which in some cases may be very serious and irreparable.
We ask our Customers to monitor their Device post liquid damage repair, as unknown issues can arise soon after treatment for liquid damage, which are beyond our control.
iRecycle may install warranty seals following the repair. Any tampering of the seals will void our warranty.
Use of our repair service will void your manufacturer’s warranty.
Any data or information that you may have stored on the Device shall remain your sole responsibility and we accept no liability for loss or corruption of such data however caused and we therefore highly recommend that you back up your Device prior to your repair.
At all times we will do our utmost to deliver on the quoted turn-around time, but in some incidences, for reasons out of our control, this cannot always be guaranteed. Our quoted repair times start when the technician begins the repair.
iRecycle provides 3 months warranty for its repair. If the Device develops an additional fault unrelated to the original repair, the repair warranty will not apply. The warranty includes the repaired/replaced part(s) only and does not include further accidental or liquid damage to these parts. If your device is repaired by a 3rd party after our service, your warranty with iRecycle will be voided.
In case the old screen of your device is not handed over to the technician, the warranty is applicable only for 3 months.
